PREAMBLE
These Terms and Conditions (hereinafter "T&Cs") govern the contractual relationship between SORANO SAS (hereinafter "the Provider") and any natural or legal person (hereinafter "the Customer") wishing to subscribe to a plan allowing the generation of dynamic QR codes styled by artificial intelligence via the qr4ever.com website (hereinafter "the Website").
These T&Cs are accessible at any time on the Website and take precedence over any other version or any other contradictory document. The Customer acknowledges having read these T&Cs and having accepted them before any subscription to a plan.
ARTICLE 1 - DEFINITIONS

- Subscription Contract by which the Customer subscribes to one of the plans offered by the Provider to access the Service.
- Customer Any natural or legal person who subscribes to a Subscription on the Website.
- Account Personal space of the Customer on the Website allowing them to access the Service after identification.
- Dynamic QR code QR code whose content can be modified after its creation, unlike static QR codes.
- Service Service for generating dynamic QR codes styled by artificial intelligence offered by the Provider.
- Website Website accessible at qr4ever.com.
ARTICLE 2 - PURPOSE
These T&Cs aim to define the rights and obligations of the parties in the context of the sale of Subscriptions offered by the Provider to the Customer.
ARTICLE 3 - SERVICE DESCRIPTION
The Service allows the Customer to generate dynamic QR codes whose appearance is customized using artificial intelligence technology. These QR codes can be modified at any time by the Customer during the term of their Subscription.
ARTICLE 4 - SUBSCRIPTIONS AND PRICING
4.1 Subscription Plans
The Provider offers three subscription plans:
- Monthly subscription: €4.99 per month (tax included)
- Annual subscription: €49.99 per year (tax included)
- Lifetime subscription: €199.99 (one-time payment, tax included)
Each subscription plan offers exactly the same features and options. Only the duration of the commitment differs.
4.2 Payment Methods
Payment is made online when subscribing to the Subscription. The accepted payment methods are as follows: Credit cards, Debit cards, Bitcoin (BTC).
For Monthly and Annual Subscriptions, payment is recurring and will be automatically charged at each renewal, unless previously terminated by the Customer in accordance with Article 9.
4.3 Commitment Period
- Monthly subscription: commitment of one (1) month, automatically renewable
- Annual subscription: commitment of one (1) year, automatically renewable
- Lifetime subscription: no commitment period, unlimited access to the Service
ARTICLE 5 - REGISTRATION AND SERVICE USE
5.1 Account Creation
To access the Service, the Customer must create an Account on the Website by providing the requested information. The Customer agrees to provide accurate information and to keep it up to date.
The Customer is solely responsible for maintaining the confidentiality of their login credentials. Any use of the Account with the Customer's credentials will be deemed to have been made by the Customer.
5.2 Generating QR Codes
Once logged into their Account, the Customer can generate dynamic QR codes by following the procedure indicated on the Website. The Customer is responsible for the content associated with their QR codes and agrees not to associate them with illegal, defamatory, obscene, or immoral content.
5.3 Availability Timeframe
Generated QR codes are made available to the Customer instantly after their creation or modification.
5.4 QR Code Usage Conditions
The Customer may use the generated QR codes for their personal or professional needs, subject to compliance with these T&Cs and applicable laws. The Customer agrees not to use the Service for illegal or fraudulent purposes.
ARTICLE 6 - INTELLECTUAL PROPERTY
6.1 Rights to Generated QR Codes
QR codes generated by the Customer via the Service are the property of the Customer, who has the right to use them in accordance with these T&Cs during the term of their Subscription.
6.2 Rights to AI-Created Designs
The stylized designs created by artificial intelligence as part of the Service are licensed non-exclusively to the Customer for the duration of their Subscription. The Provider retains all intellectual property rights relating to the artificial intelligence technology used to generate these designs.
6.3 Rights to the Website and Service
The Website and the Service, including technologies, software, texts, images, graphics, and any other constituent element, are the exclusive property of the Provider and are protected by intellectual property rights. Any reproduction, representation, modification, or exploitation of all or part of the Website or the Service without the prior authorization of the Provider is strictly prohibited.
ARTICLE 7 - PERSONAL DATA
7.1 Types of Data Collected
To provide the Service, the Provider collects and processes the following personal data: - Identification information (name, surname, email address) - Billing information - IP address and connection data - Service usage data
7.2 Purposes of Processing
Personal data are collected and processed for the following purposes: - Provision and management of the Service - Management of Subscriptions and billing - Communication with the Customer - Service improvement - Compliance with legal obligations
7.3 Data Retention Period
Personal data is kept for the entire duration of the Customer's Subscription, then for a period of three (3) years from the end of the Subscription or the last contact with the Customer. Billing data is kept for ten (10) years in accordance with legal obligations in accounting matters.
7.4 User Rights
In accordance with applicable regulations on personal data protection, particularly Regulation (EU) 2016/679 (GDPR), the Customer has the following rights: - Right to access their personal data - Right to rectify their personal data - Right to erase their personal data - Right to restrict processing - Right to object to processing - Right to data portability To exercise these rights, the Customer can contact the Provider at the following email address: support@qr4ever.com.
ARTICLE 8 - CUSTOMER SERVICE AND WARRANTIES
8.1 Technical Support
The Provider makes available to the Customer a technical support service accessible by email at support@qr4ever.com. The Provider endeavors to respond to support requests within a reasonable time, during business days.
8.2 QR Code Functionality Warranties
The Provider guarantees the proper functioning of dynamic QR codes generated via the Service for the entire duration of the Customer's Subscription, subject to use in accordance with the technical recommendations provided on the Website.
8.3 Complaint Procedure
For any complaint, the Customer can contact customer service at the email address support@qr4ever.com. The Provider undertakes to process the complaint as soon as possible and to propose an appropriate solution.
ARTICLE 9 - TERMINATION
9.1 Termination by the Customer
9.1.1 Monthly or Annual Subscription
The Customer can terminate their Monthly or Annual Subscription at any time via their Account or by contacting customer service at the email address support@qr4ever.com. The termination will take effect at the end of the current Subscription period, without automatic renewal.
9.1.2 Lifetime Subscription
The Lifetime Subscription cannot be terminated once subscribed, except in the case of serious breach by the Provider of its obligations.
9.2 Consequences of Termination
In the event of Subscription termination: - Access to the Service will be suspended on the effective date of termination - Dynamic QR codes generated by the Customer will no longer be accessible or modifiable - Data associated with QR codes will be kept for a period of thirty (30) days after termination, allowing the Customer to reactivate their Subscription and recover their QR codes during this period
9.3 Refund Conditions
9.3.1 Right of Withdrawal
In accordance with applicable legal provisions, the Customer has a period of fourteen (14) days from the subscription to the Subscription to exercise their right of withdrawal, without having to justify reasons or pay penalties.
To exercise this right, the Customer must inform the Provider of their decision to withdraw by a clear and unambiguous statement, sent to the email address support@qr4ever.com.
In the event of exercising the right of withdrawal, the Provider will reimburse the Customer for all payments received, no later than fourteen (14) days from the day the Provider is informed of the Customer's decision to withdraw.
9.3.2 Other Refund Cases
Outside of the right of withdrawal, no refund will be made in case of termination of a Monthly or Annual Subscription during the current period.
For the Lifetime Subscription, no refund will be made after the withdrawal period of fourteen (14) days.
ARTICLE 10 - LIMITATIONS OF LIABILITY
10.1 Service Availability
The Provider strives to ensure the availability of the Service 24 hours a day and 7 days a week. However, the Provider cannot guarantee continuous and uninterrupted availability of the Service, particularly in the event of necessary maintenance or force majeure.
The Provider reserves the right to temporarily interrupt access to the Service for maintenance or improvement reasons, making efforts to inform the Customer beforehand.
10.2 Exclusions of Liability
The Provider shall not be held liable for: - Temporary malfunctions or unavailability of the Service due to maintenance operations or circumstances beyond its control - Fraudulent or abusive use of the Service by the Customer or by third parties - Content associated with QR codes generated by the Customer - Indirect damages, such as data loss, loss of opportunity, loss of profit, damage to image or reputation - Consequences of non-performance by the Customer of their obligations under these T&Cs
The Provider's liability, if engaged, will be limited to the amount paid by the Customer for the Subscription in question during the last twelve (12) months.
ARTICLE 11 - FORCE MAJEURE
Neither party shall be held responsible towards the other for the non-execution or delays in the execution of an obligation of these T&Cs which would be due to the occurrence of a case of force majeure, as defined by Article 1218 of the Civil Code and by the jurisprudence of French courts.
The party noting the event of force majeure must inform the other party as soon as possible. The performance of obligations will then be suspended until the disappearance of the case of force majeure.
In the event of persistence of the case of force majeure for more than thirty (30) days, each of the parties may terminate the current Subscription without compensation.
ARTICLE 12 - MISCELLANEOUS PROVISIONS
12.1 Partial Invalidity
If one or more provisions of these T&Cs are held to be invalid or declared as such under any law, regulation, or following a final decision of a competent court, the other provisions shall keep all their force and scope.
12.2 Non-Waiver
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these T&Cs shall not be interpreted as a waiver of the obligation in question.
12.3 Modification of T&Cs
The Provider reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in force on the date of subscription or renewal of the Subscription.
In the event of a substantial modification of the T&Cs, the Provider will inform the Customer at least one (1) month before the entry into force of the new T&Cs. If the Customer does not accept the new T&Cs, they may terminate their Subscription without charge before their entry into force.
ARTICLE 13 - APPLICABLE LAW AND COMPETENT JURISDICTION
These T&Cs are governed by French law.
In the event of a dispute relating to the formation, interpretation, execution, or termination of these T&Cs, the parties will endeavor to find an amicable solution.
Failing an amicable agreement, any dispute will be submitted to the exclusive jurisdiction of the courts of Paris, subject to contrary imperative legal provisions.
